DMCA Policy
To report infringing content, email dmca@shortclip.pro with subject line "DMCA Takedown Notice." Include all required elements listed in Section 3 below. We acknowledge within 2 business days.
1. Overview
ShortClip respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, ShortClip will respond expeditiously to claims of copyright infringement committed using our platform if such claims are reported to our designated copyright agent.
This page describes how to file a DMCA takedown notice, what happens after we receive one, and how an affected user may submit a counter-notice.
2. What Is a DMCA Takedown Notice?
A DMCA takedown notice is a formal request from a copyright owner (or their authorized representative) asking a service provider to remove content that allegedly infringes their copyright. Under the DMCA, if ShortClip receives a valid takedown notice and acts in good faith to remove the reported content, we are shielded from copyright liability (the "safe harbor" provision).
Note: Filing a false DMCA notice is a criminal offense. Misrepresenting that material is infringing — or that material was removed by mistake — may result in civil liability for damages, including costs and attorneys' fees.
3. How to File a Takedown Notice
To file a valid DMCA takedown notice, send a written communication to our designated copyright agent that includes ALL of the following elements required by 17 U.S.C. § 512(c)(3):
1. **Identification of the copyrighted work** — Describe the copyrighted work you claim has been infringed. If multiple works are covered, a representative list is acceptable.
2. **Identification of the infringing material** — Provide the specific URL(s) or other information sufficient for us to locate the material you claim is infringing.
3. **Your contact information** — Your full legal name, mailing address, telephone number, and email address.
4. **Good faith statement** — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. **Accuracy statement** — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
6. **Signature** — A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
4. Where to Send Your Notice
Send completed DMCA takedown notices to our designated copyright agent:
Email (preferred): dmca@shortclip.pro Subject line: DMCA Takedown Notice
Mail: ShortClip — DMCA Agent Attn: Legal Department hello@shortclip.pro
We process email notices significantly faster than physical mail. We aim to acknowledge receipt within 2 business days and act on valid notices within 5 business days.
5. What Happens After We Receive a Notice
Upon receipt of a complete and valid DMCA notice, ShortClip will:
1. Acknowledge receipt of the notice. 2. Remove or disable access to the allegedly infringing content promptly. 3. Notify the user who submitted the content that their material has been removed and the reason why. 4. Provide the user with information about filing a counter-notice if they believe the removal was in error.
We reserve the right to forward the notice (with your contact information) to the affected user and to post it to public transparency databases such as the Lumen Database.
6. Repeat Infringers
ShortClip has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. A "repeat infringer" is a user who has been the subject of more than two valid DMCA takedown notices within any 12-month period. Account termination for repeat infringement is at ShortClip's sole discretion and may be implemented without prior notice.
7. Counter-Notice Procedure
If you believe your content was removed as a result of a mistake or misidentification, you may file a DMCA counter-notice. A valid counter-notice must include:
1. **Identification of the removed material** — Describe the material that was removed and the location where it appeared before removal.
2. **Statement under penalty of perjury** — A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
3. **Consent to jurisdiction** — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which ShortClip may be found), and that you will accept service of process from the person who provided the original DMCA notice.
4. **Your contact information** — Your full legal name, address, telephone number, and email address.
5. **Signature** — Your physical or electronic signature.
Send counter-notices to: dmca@shortclip.pro with subject line "DMCA Counter-Notice."
8. What Happens After a Counter-Notice
Upon receipt of a valid counter-notice, ShortClip will:
1. Forward a copy of the counter-notice to the original complainant. 2. Inform the complainant that we will restore the removed content in 10–14 business days unless the complainant notifies us that they have filed a court action seeking an order to restrain the user from infringing activity.
If no such court action is filed, ShortClip will restore the content within the stated period.
9. Good Faith and Abuse
ShortClip only processes DMCA notices submitted in good faith. We reserve the right to decline to act on notices that appear to be abusive, frivolous, or submitted in bad faith. If you are unsure whether content infringes your copyright, consult a qualified attorney before submitting a notice.
Abusing the DMCA process — for example, filing notices to remove content that does not infringe your copyright, or that you are not authorized to protect — may expose you to legal liability under 17 U.S.C. § 512(f).
10. User Responsibility
ShortClip's services are intended to help creators repurpose their own content or content for which they hold the necessary rights. By using ShortClip, you represent and warrant that:
• You own or have a valid license to all video content you submit for processing. • Your use of the content does not infringe the copyrights, trademarks, or other intellectual property rights of any third party. • You will not use ShortClip to circumvent technological protection measures on any copyrighted work.
Violation of these representations may result in immediate account suspension and legal action.
